From what I read ...http://crime.about.com/od/gunlawsbystate鈥?/a> ...
it looks as if you have to wait until your 30 if violence was involved. Sorry man, maybe you can find an exception to the rule. Can i buy hunting rifle even if i have a juvenile record?
Depends on the severity of the crime. Found this on the internet after some research
';A felony listed in section 707 of the Welfare and Institutions code will disqualify you from owning a firearm and from having a juvenile record sealed.
In California, juveniles are confined for rehabilitation or ordered to probation under section 602 of the Welfare and Institutions code. There are specific penal code sections listed in section 707 of the Welfare and Institutions determine how their record will be treated, if they are eligible to have their record sealed, and if there are any permanent restrictions. Burglary is not listed in section 707 WIC.
Some juvenile courts will, depending on the age, alleged crime, and level of sophistication, order probation, upon successful completion of probation withdraw the plea, and dismiss the charges鈥?quot;
You can use this link to find out if you are eligible to buy a gun http://ag.ca.gov/firearms/forms/pdf/pfec鈥?/a>
in all honesty though you gonna have a tough time in california bc they have some of the most strict laws of all the states
One question:
Was violence or a weapon involved? If yes to either, you're done. No ownership of firearms.
If not, then you will have to petition the convening court, the convicting DA, and the chief Law Enforcement Officer involved. Even then, if you are successful, you will probably find that few Dealers will want to have business with you. I live in Texas, and have been dealing in guns for over thirty years, and only one single case did the buyer meet every requirement to ATF standards, and he brought me a veritable telephone book sized folder of documents. And his crime was a simple pot posession bust from the Sixties. Yes, he did get his shotgun (as long as it is not of a ';Tactical'; design, and you bet, an ATF Agent was there when I issued the transfer).
It ain't easy, but it is possible. Plan on a year or two of paper gathering.
Good luck and stay clean.
There is only one way you can be sure, and that is to contact the California DOJ. Your juvenile felony may not disqualify you, but you never know until you check. I am aware of at least one instance in which a man had to go to court to get his juvenile record unsealed in order to purchase firearms (the reasoning of the DOJ was that an sealed record might hide a permanently disqualifying incident).
Anyway, the DOJ has a form you can download, complete and send to them. They will respond and tell you their decision. The fee is $20 and has to be notarized.
You might be tempted to simply buy a rifle then wait to see if the DOJ approves the sale through the DROS process. However, that course of action does involve some risk. Technically, attempting to purchase a firearm after you have lost to right to own a firearm is a crime (in California)--so if your DROS is not approved you may get a visit from local law enforcement. On the other hand, I am unaware of anyone who has been prosecuted under the statute.
My advice is to play it safe, complete the ';PERSONAL FIREARMS ELIGIBILITY CHECK APPLICATION'; (link below), and take it from there.
Contact you local District Attorneys Office to see if your juvenile records have been sealed. If yes, you might be able to make the purchase. If no, I'm afraid your out of luck for the rest of your life.
You use the word ';felon'; a lot. Were you convicted of a felony or misdemeanor and was it firearms related? That may matter.
If you came into my shop, I'd run the NICS Check before we conducted any business since your not sure.
EDIT: I see your other questions; Can i buy a hand gun even though i was convicted of assault with a deadly weapon as a juvenile? (8years ago)?
I'm glad you are in California, I'll never see you here. With your admission of that conviction I would never sell a firearm to you. Juvi or not.
Since the other question you posted was to purchase a handgun after you were convicted of assault with a deadly weapon, I sure hope not.
I'm not saying people can't change, but this is suspect at best. Call a lawyer and have money ready.
in most states if you have been convicted of a felony or of domestic violence you are not eligible to posses a fire arm some felonies are overlooked and you can still get one but since your in California i highly doubt you can buy a gun.
For a correct answer you might have to have an attorney checkk this out. Juvenile records are usually sealed upon maturity and cannot be accessed by anybody but God.
what class of felony was it?
